About Process Serving in New York
New York does not require a statewide process server license, but NYC imposes significant requirements for servers working within the five boroughs who serve five or more processes per year. NYC licensees must pass an exam, post a $10,000 bond, provide fingerprints, and use GPS tracking devices when serving. Service must be completed within 120 days of filing the summons and complaint under CPLR 306-b.
- License Required: New York does not require a statewide license, but process servers working in New York City (5 boroughs) who serve 5 or more processes per year must be licensed by NYC DCWP.

Any person 18 or older who is not a party to the action may serve process in New York outside of NYC. Within New York City, servers who serve 5 or more processes per year must be licensed by NYC DCWP under the NYC Administrative Code. Attorneys and government employees are exempt from the NYC licensing requirement.
If personal delivery cannot be completed, New York allows substitute service at the defendant's dwelling or business plus mailing (CPLR 308(2)). After due diligence, "nail-and-mail" service — affixing to the door plus mailing — is available under CPLR 308(4). Court-ordered service under CPLR 308(5) is available when other methods are impracticable.
